Booking Conditions

These are the standard Booking Conditions of International Friends and GTS Tours, part of the GTI Travel Group Ltd (“GTI”, “we” or “us”), whose address is Kent Innovation Centre, Thanet Reach Business Park, Millennium Way, Broadstairs, Kent, CT10 2QQ, telephone number is +44(0) 1223 244 555 and email is [email protected].  These Booking Conditions include the terms that apply when you book travel arrangements with GTI, however depending on what travel arrangements you book, certain parts of these Booking Conditions only apply to the booking arrangements and other parts will apply in full if you book a package of travel services organised by us (“package”).  We will explain throughout these Booking Conditions where we are responsible to you when we organise a package for you, as well as who would be responsible to you if we are putting a booking in place between you and another travel organiser, for whom we act as agent.

These Booking Conditions and any other written information brought to your attention before we confirm your booking (including the description of the travel services you have booked when we organise a package for you), form the basis of your contract with GTI Travel Group Ltd trading as "International Friends" and "GTS Tours". These Booking Conditions apply when we sell under either brand.

Please read these Booking Conditions carefully as they set out our respective rights and obligations. In these Booking Conditions references to "you" and "your" include the first named person on the booking and all persons on whose behalf a booking is made or any other person to whom a booking is added or transferred.  By making a booking, the first named person on the booking agrees on behalf of all persons detailed on the booking that:-

  1. He/she has read these Booking Conditions and has the authority to and does agree to be bound by them on he/she’s own behalf and on behalf of all persons detailed on the booking;
  2. He/she consents to our use of information in accordance with our Privacy Policy;
  3. He/she is over 18 years of age and where making a booking for travel services with age restrictions, declares that he/she and all members of the party are of the appropriate age to purchase those travel services.

Our obligations to you vary depending upon whether you book a single component through us for a single travel service,  or whether you purchase a package that we have organised for you. A "package" means a holiday that combines two or more travel services, combined for the purposes of the same trip. ‘Travel services’ could include (i) transport (eg, flights, trains, ferry and coaches); (ii) accommodation (unless part of transportation of passengers); (iii) motor vehicle hire; and (iv) other tourist services (which are not intrinsically part of the carriage of passengers, accommodation or motor vehicle hire). All packages offered for sale with us, which include an overnight stay, transport and excursions are packages for the purpose of the Package Travel and Linked Travel Arrangements Regulations 2018 (“Package Regulations”). Any single component bookings for an individual travel service (such as a transfer which is not included as part of a package or that is an intrinsic part of another travel service), does not constitute a package as defined in the Package Regulations.

  1. International Bookings
All bookings made for a package organised by us either directly with us or via one of our agents (either in the UK or internationally) are subject to English law and the non-exclusive jurisdiction of the English courts. You may choose the law and jurisdiction of Scotland or Northern Ireland if you live there and wish to do so.  By making a booking and paying your deposit either directly or via our agent, you accept that English law applies.

  2. Booking and Paying For Your Arrangements
2.1 A booking is made with us for a package organised by us when a) you or your travel agent tells us that you would like to accept our written or verbal quotation (if issued); b) you pay us a deposit or full payment (depending on what we request from you at the time of booking); and c) we issue you with a booking confirmation for the full package. Where we create a bespoke package for you, then individual elements of your trip may be booked gradually whilst the package is built and deposits taken for securing those elements of the booking, however the contract for the full package does not come into existence until the full package booked is confirmed to you.  We may email you when individual elements are booked to let you know our progress on the booking process, but a binding contract for that full package only comes into existence when we issue the final confirmation for the full package.

A binding contract will therefore only come into existence once we have issued you with a booking confirmation that will confirm the details of your full booking arrangements, and not before. Upon receipt, if you believe that any details on the booking confirmation (or any other document) are wrong you must advise us immediately.  When you create a bespoke package for you, if you pay deposits as requested by us and the full package arrangements cannot be completed, then we will issue you with a refund of those deposits paid.  Where we have taken deposits from you in relation to the cost of your arrangements, the balance of the cost of your arrangements (including any applicable surcharge) is due not less than 3 months prior to scheduled departure for all of the travel arrangements that we sell. If we do not receive this balance in full and on time, then subject to us issuing you with a reminder prior to the due date for such balance, we reserve the right to treat your booking as cancelled by you in which case the cancellation charges set out below are applicable.

2.2 The principal’s/tour operator’s or supplier’s(s’) Terms & Conditions (“Supplier Terms”) will apply to your booking and we advise you to read these carefully as they do contain important information about your booking. Please ask us for copies of these if you do not have them.  If there is a conflict between the Supplier Terms and these Booking Conditions, these Booking Conditions shall prevail to the extent only that there is any inconsistency between the Supplier Terms and these Booking Conditions. If applicable, Supplier Terms will apply in addition to our terms as set out in these Booking Conditions.

2.3 Payments are generally made by either online secure payment, cheque or by electronic bank transfer. We may accept credit card payments from you, however we reserve the right to make a charge based on the cost to us of processing that credit card payment for you.

  3. Financial protection
3.1 We provide financial protection for the packages that we organise. Financial protection for packages organised by other principals / tour operators will be as described in the relevant package description and not under our financial protection mechanism.

3.2 We do not sell flights, or organise packages that include any flights, therefore we are not required to hold an ATOL licence. GTI Travel Group Limited is a company committed to customer satisfaction and consumer financial protection. We are therefore pleased to announce that we insure our customers' monies in accordance with the minimum requirements set out by the EU "The Package Travel, Package Tours Regulations" The policy includes repatriation if required, arising from the cancellation or curtailment of your travel arrangements due to the insolvency of GTI
Travel Group Limited. This insurance has been arranged by The Travel Vault in conjunction with Towergate Travel through Zurich Insurance PLC.
Claims : In the unlikely event of Insolvency, you must Inform Towergate Travel immediately on +44 (0) 1932 334140 or by email at [email protected] . Please ensure you retain the booking confirmation form as evidence of cover and value.
Policy exclusions: This policy will not cover any monies paid for Travel Insurance

3.3 If you are booking with an agent or re-seller, it is your responsibility to check whether they provide any different financial protection, in accordance with the Package Regulations. Our financial cover only extends to clients or companies who have contracted directly with us, for the packages that we organise. This means we cannot provide cover should your agent or re-seller experience financial difficulties or cease trading. In such circumstances, we would treat affected bookings as cancelled.

3.4 Please note that where we sell single component travel services, this is not a package and is therefore not required to be given any financial protection for monies you may pay for that single component travel service.  Where a principal / supplier provides its own financial protection for that single component, then where we are acting as an agent of that principal / supplier, the principal / supplier’s own financial protection mechanism will apply to protect monies that are paid to that principal / supplier in respect of their insolvency.  You should check the relevant Supplier Terms (as may be applicable) at the time of booking, to ensure you are clear on what financial protection may be in place in relation to such arrangements booked.

  4. Alterations and cancellations by you

4.1 Our packages: If, after our confirmation has been issued, you wish to make a change to the package that we have organised for you, we will do our utmost to make the changes provided that notification is received in writing at our offices from the person who made the booking. We reserve the right to charge an administration fee of £50.00 per person in order to process that change, in addition to any further cost in making the alteration. You should be aware that these costs could increase the closer to the departure date that changes are made and you should contact us as soon as possible. Please note that certain travel arrangements may not be changeable after a reservation has been made and any alteration request could incur a cancellation charge of up to 100% of that part of the arrangements.

4.2 You, or any member of your party, may cancel your package arranged by us at any time provided that notice of the cancellation is made to our offices by the person who made the booking and is in writing. As certain travel arrangements and bookings cannot be changed after confirmation, cancellation incurs administration costs - we will retain your deposit and in addition may apply cancellation charges up to the maximum shown in Clause 4.3 below.

4.3 Period before departure within which written confirmation of cancellation is received and amount of cancellation charge shown as a percentage of the package price:

4.5 You can cancel your booking without paying cancellation charges if the performance of any package we organise for you is significantly affected by unavoidable and extraordinary circumstances.  In such circumstances, we will arrange for your booking to be terminated and for you to receive a full refund. We will observe advice provided by the UK Foreign & Commonwealth Office.

4.6 Transfer of booking: You can transfer your booking to another person, who satisfies all the conditions that apply to this booking, by giving us notice in writing at least 7 days before departure.  Both you and the new traveller are responsible for paying all costs we incur in making the transfer.

4.7 Changes to other bookings: Where you have booked another principal / tour operator or supplier’s travel arrangements (including any package organised by another tour operator or organiser), then we will pass on your request to make any changes to your booking, but any such changes will be subject to the Supplier Terms and we will not be responsible for any changes requested to be made to your booking.

5. Alterations and cancellation by us

5.1 It is possible that we may have to make changes to the package we organise for you (other than the price). Occasionally changes may be made, and we reserve the right to do so at any time. Most of these changes are insignificant and we will ensure that we advise you as early a possible.  Departure timings in the promotional literature are for guidance only. Actual times will be given to you with your travelling documentation.

Examples of insignificant changes include alteration of your departure time by less than 12 hours, change of accommodation or transportation to another of the same standard or higher standard.

5.2 If a major change becomes necessary and we are constrained by circumstances beyond our control to significantly alter any of the main characteristics of the travel services that make up your package organised by us, you will have the rights set out below.

We will inform you as soon as reasonably possible if there is time before departure. You will have the choice of either accepting the change of arrangements, accepting an offer of available alternative travel arrangements of comparable standard from us (where we offer one and we will refund any price difference if the alternative is of a lower value) or cancelling the package we have organised for you and receiving a full refund of all monies paid. We will tell you the procedure for making your choice.  Please read any notification of changes carefully and respond promptly as if you do not response to us within the timescale given, your booking may be cancelled.

If you choose to accept a refund we will pay compensation as detailed below except where the significant change is due to unavoidable and extraordinary circumstances (as defined below).

5.3 We reserve the right to cancel your booking of a package organised by us. In this case we offer the choice of an alternative tour of comparable standard, if available (we will refund any price difference if the alternative is of a lower value), or a full refund of all monies paid. We will not cancel less than 42 days before the scheduled departure date except for reasons of unavoidable or extraordinary circumstances eg. if minimum numbers are not reached, or your failure to pay the final balance.  The minimum number required will be provided to you with the description of the package arrangements you book, along with the time limit for us to tell you if the package has to be cancelled.

If the package we have organised for you is cancelled you can either have a refund of all monies paid or accept an alternative holiday or comparable standard from us if we offer one (we will refund any price difference if the alternative of is lower value).  In the event a refund is paid to you, we will pay compensation as detailed below except where the cancellation is due to unavoidable and extraordinary circumstances.

5.4 If it is necessary to cancel the package we have organised for you (except for reasons of unavoidable and extraordinary circumstances) or make a significant change after the date when payment of the balance becomes due, we will in addition pay you compensation as follows:

Period before departure within which Compensation notification of change or cancellation is given per person

More than 42 days. .  . . . . . . . . . . . . . . . . . . . . . Nil

41 – 1 day… . . . . . . . . . . . . . . . . . . . . . . . . . . £50

Please note compensation is not payable in the case of minor changes. The compensation offered does not exclude you from claiming more if you are entitled to do so.

‘Unavoidable and extraordinary circumstances’ means a situation beyond our control, the consequences of which could not have been avoided even if all reasonable measures had been, including (for example) but not limited to, war, riot, industrial dispute, terrorist activity and its consequences, natural or nuclear disaster, fire, adverse weather conditions, epidemics and pandemics, unavoidable technical problems with transport

6. Alterations to itinerary

6.1 You will appreciate that arrangements and destinations, including ports for stopping or sailing paths, or other coach stopping points, may need to be changed without notice. Fortunately, this is a rare occurrence but nevertheless disappointing, although must be done in order to ensure safe transportation and the safety of the crew, staff and guests travelling on that means of transportation. Every effort is made to inform you about changes as soon as possible, but this may require notification at the time due to change in sea activity, weather, roadworks or other reason beyond our control. The change of an itinerary or other transportation course are entirely outside our control, including where there are adverse weather conditions.

6.2 Please note that the order of events on itineraries is subject to alteration due to local circumstances, unscheduled closures of ports or roads, etc. However, every effort will be made to include all elements of the programme during your trip, or a suitable alternative which will be notified to you.

6.3 Accident or Injury to Tour Guide: If the tour leader of a package organised by us is involved in an accident, or is unable to continue the tour for whatever reason, we will endeavour to provide a replacement tour leader. In the event that a tour leader cannot be located, the participants may continue with the tour, maps and hotel details will be provided. The participants will receive a refund in relation to the diminution in value between the 'guided' tour and the 'mapped' tour.

7. Tour Meeting Points

The tour leader will outline at the beginning of the tour the next meeting point within an itinerary (and/or as specified on any ticket or travel documentation), and the point in which the group should meet (including the meeting time), and will leave the next meeting point. It is the group participant's responsibility to meet at the designated point, and be ready for driving at the designated start point, at the beginning of the tour and during the tour. Group participants that fail to meet up at any designated meeting place and time are liable for their own expenses in meeting back up with the group, including (but not limited to) any additional costs in transportation or other means of meeting back up with the group.  You acknowledge that even if you have contacted us or any representative that may be running the tour, to let them know that you are unable to meet back up with the group at any point of the tour (including, but not limited to, if you are running late and/or are lost), that the tour cannot always wait for you and may therefore proceed without you and you will need to make your own arrangements to meet back up with the tour in such instances.

8. Risks

Some of our more adventurous packages, for example (and not by way of limitation)  Horse Riding in Wild Wales, are not without risks. You must be adequately fit and of an adequate proficiency indicated in accordance with the booking form to undertake the program set out in the Tour you have chosen. Your booking is accepted on the understanding that you realise the hazards involved in your chosen activity. You acknowledge that by the very nature of the activities you are exposed to an element of personal risk and that the activities are of a potentially hazardous and unpredictable nature above those associated with conventional holidays. You therefore accept and consent to the risks inherent in participating in such activities and accept the limitations of our responsibility to you in respect of any such activities included in any of the packages we organise for you, as set out in these Booking Conditions.

9. Pricing

9.1 Where we provide you with a quote for the travel services we make available to you, then the price for those travel services will be as set out in that quotation.  Prices for travel services that are displayed on our website are indicative and we take all reasonable care to ensure that the prices advertised are accurate, however occasionally changes may be made to the prices or errors may be made in the displayed price and we therefore reserve the right to check the prices for any travel services you wish to book prior to your booking and we will confirm the applicable price to you prior to the time of booking.

9.2 Our prices are inclusive of all items listed on your itinerary.

9.3 Without limiting Clause 9.2, for packages we organise for you, our prices will include accommodation, transportation and entries to sites, etc, as confirmed to you at the time of booking. Our prices do not generally include meals, site seeing/ historical sites tours, visa or border fees, costs of replacing any documentation, onward flights or transportation, insurance or insurance excess, costs of snacks, drinks and other food items, unless where stated otherwise by us at the time of booking.

9.4 We can change the price of any package that we organise for you after you’ve booked, only in certain circumstances. Changes in the price of your package that we organise for you can be made due to changes in: transportation costs i.e, the price of the carriage of passengers resulting from changes to the cost of fuel or other power sources; the level of taxes or fees imposed by third parties including tourist taxes, landing taxes or embarkation or disembarkation fees at ports; or exchange rates, mean that the price of your travel arrangements may change after you have booked. However, there will be no change within 20 days of your departure. Where there is an increase in such price of your travel arrangements, you will be charged for this if this means that there is an increase of the price of your travel arrangements by 8%.  Where there is an increase in the price of your travel arrangements of more than 8%, you will have the option of accepting a change to another holiday if we are able to offer one (and we will refund any price difference if the alternative is of a lower value), or cancel and receive a full refund of all moneys paid, except for any amendment charges. Should you decide to cancel: (1) you must do so within the time period shown on your final invoice; (2) we will provide a refund of insurance premiums paid to us if you can show that you are unable to transfer of reuse your policy. Whether you cancel or not you will also be entitled, under the terms set out in respect of major changes (Alterations and Cancellations by us) to accept from us an offer of alternative travel arrangements if we are able to do so and compensation as set out below.

9.5 Should the price of any package we have organised for you go down due to the changes mentioned above, then any refund due will be paid to you. We will deduct from this refund our administrative expenses incurred.  Please note that travel arrangements are not always purchased in local currency and some apparent changes have no impact on the price of your travel due to contractual and other protection in place.

9.6Where we sell you single travel services (not a package), as we informed you in the description of that single travel service in our quotation to you (or as advertised on our website), we may change the price of the single travel service in the event of any imposed VAT or other tax or governmental levy imposed which affects the price of the single travel service, but if we do so we will notify you.  You may then contact us to end the contract before the changes take effect and receive a refund for any monies paid in accordance with the cancellation provisions set out in Clause 4 of these Booking Conditions.

10. Special Requests

Any special requests in relation to your booking must be advised to us at the time of booking e.g. diet, room location, a particular facility at a hotel etc. You should then confirm your requests in writing. Whilst every effort will be made by us to try and arrange your reasonable special requests, we cannot guarantee that they will be fulfilled.  The fact that a special request has been noted on your confirmation invoice or any other documentation or that it has been passed on to the supplier is not confirmation that the request will be met. Failure to meet any special request will not be a breach of contract on our part unless the request has been specifically confirmed.

11. Persons of reduced mobility and medical issues

We are not a holiday company which specialises in tours or other travel arrangements for persons of reduced mobility, but we will do our utmost to cater for any special requirements you may have. If you or any member of your party has any reduced mobility requirements or has a medical condition which may affect your tour or their ability to participate in any activity or part of the tour or trip, please provide us with full details at the time of your booking request, so that we can try to advise you as to the suitability of your chosen arrangements. Acting reasonably, if we are unable to properly accommodate the needs of the person(s) concerned, we will not confirm your booking or if you did not give us full details at the time of booking, we may cancel it and impose applicable cancellation charges when we become aware of these details and have made a reasonable suitability assessment.

12. Our liability to you

12.1 In respect of our packages that we organise for you, we will be responsible to you for the arrangements we agree to provide or arrange for you as an "organiser" under the Package Regulations, as set out below. Subject to these Booking Conditions, if we or our suppliers fail to perform the contracted package arrangements, we will be liable to you in accordance with this clause.

12.2 You must inform us without undue delay of any failure to perform or improper performance of the travel services included in the package we have organised for you.  If any of the travel services included in the package we have organised for you are not performed in accordance with the contract, or any improperly performed, by the travel service suppliers, and this has affected the enjoyment of your travel arrangements, you may be entitled to an appropriate price reduction or compensation, or both.  However, we will not be liable where any failure to perform or improper performance of the travel services is due to you or another member of your party; or a third party unconnected with the provision of the travel arrangements and whether the failure is unforeseeable or unavoidable; or unavoidable and extraordinary circumstances (as defined above) beyond our control, the consequences of which could not have been avoided even if all reasonable measures had been taken.  Our liability to you for such package arrangements we have organised for you shall in all cases (except where they lead to death, injury or illness, or in accordance with clause 12.3 below) be limited to a maximum of three times the cost of the original package cost.

12.3Our liability to you under these Booking Conditions will also be limited in accordance with and/or in an identical manner to:

i) the contractual terms of the companies that provide the travel services that make up your package, which are incorporated into this booking; and

ii) any relevant international conventions (for example, the Montreal Convention for travel by air, the Athens Convention for travel by sea, the Berne Convention for travel by rail and the Paris Convention for accommodation), which limit the amount of compensation that you can claim for death, injury, delay to passengers and loss, damage and delay to luggage. We are to be regarded as having all benefit of any limitation of compensation contained in these or any conventions.

You can ask for copies of the travel service contractual terms, or the international conventions, from us.

12.4 If you, or any member of your party, suffers death, illness or injury whilst overseas arising out of activity which does not form part of the inclusive holiday arrangements or excursion arrangements through us (as per clause 18 below), we shall at our discretion, offer advice, guidance and assistance to help in resolving any claim you may have against a third party. We limit the cost of our assistance to you or a member of your party to £5,000.00 in total. Where legal action is contemplated and you want our assistance you must obtain our authority prior to commencement of proceedings. Our consent will be given subject to you undertaking to assign any costs, benefits received under any relevant insurance policy to ourselves.

12.5 If you are prevented from travelling on any means of transportation that forms part of the package we organise for you, because in the opinion of any person in authority, you appear, by reason of intoxicating liquor or use of drugs, either to be unfit for travel or likely to cause discomfort or disturbance to other passengers, our responsibility for your journey, including any return journey thereupon ceases. You must accept responsibility for your proper conduct and we therefore have the right to terminate our contract in circumstances of serious misconduct by you or any member of your party.  Without limiting this clause, all participants on the tour are expected to conduct themselves in an orderly and acceptable manner and not to disrupt the enjoyment of other participants. If in our reasonable opinion your behaviour or that of any member of your party is causing or is likely to cause distress, danger or annoyance to any of our other guests or any third party or damage to property, or to cause a delay, we reserve the right to terminate your booking arrangements with us immediately. In the event of such termination our liability to you and/or any relevant member of your party will cease and you and/or any relevant member of your party will be required to leave your accommodation or other service immediately. We will have no further obligations to you and/or any relevant member of your party. No refunds for lost accommodation or any other service will be made to you and/or any relevant member of your party, in such circumstances. You and/or any relevant member of your party may also be required to pay for loss and/or damage caused by your or their actions and you and/or any relevant member of your party will need to indemnify us and/or any other third party for any liability for any damage or losses caused by you and/or any relevant member of your party.

NB: This clause does not apply to any separate contracts that you may enter into for excursions or activities whilst on holiday.  This clause also does not apply where we are not the organiser of a package or where we sell you a single component, in which case the principal / tour operator and/or supplier will be responsible to you in accordance with their Supplier Terms.

13. Complaints

If you have a compliant about any of the services included in a package that we organise for you, you must inform the relevant supplier without undue delay, who will endeavour to put things right quickly. If your complaint cannot be resolved locally with that supplier, you must make a report as soon as possible to us to our office detailed on our invoice to you upon your return from your trip and within 28 days from the date that your package or travel arrangements with us finish, by writing to us giving your booking reference number and all other relevant information, by writing to us.  Please keep your letter concise and provide all relevant information. If you fail to follow the requirement to report your compliant in resort, we will have been deprived of the opportunity to investigate and rectify it and this may affect your rights under this booking.

14.Prompt Assistance

The Package Regulations provide that in the event that you experiencedifficulty whilst in resort, we will provide you with prompt assistance.

Where you experience a delay which is not owing to any failure by us, our employees or sub-contractors, this prompt assistance is likely to extend to providing help in locating refreshments, accommodation and communications but not paying for them. Any transport supplier may however pay for or provide refreshments and/or appropriate accommodation and you should make a claim directly to them. Subject to the other terms of these Booking Conditions, we will not be liable for any costs, fees or charges you incur in the above circumstances, if you fail to obtain our prior authorisation before making your own travel arrangements.

15. Passport, Visa and Immigration Requirements and Health Formalities

15.1You and your party’s specific passport, visa and other immigration requirements are your responsibility and we do not accept responsibility for the validity of your passports or visas or for the refusal of visas by the Issuing Authorities. You should therefore confirm these with the relevant authorities, Embassies and/or Consulates. We shall not be liable for any loss, expense, cost, damage, injury or loss of enjoyment suffered as a result of such invalidity or loss, including any responsibility if you cannot travel because you have not complied with such requirements.

15.2 Non British passport holders, including other EU nationals, should obtain up to date advice on passport and visa requirements from the Embassy, High Commission or Consulate of your destination or country(ies) through which you are travelling.

16.  Excursions

Excursions or other tours that you may choose to book or pay for whilst you are on your package (unless offered for sale by us) are not part of your package holiday provided by us. For any excursion or other tour that you book, your contract will be with the operator of the excursion or tour and not with us and does not form part of any package organised by us. We are not responsible for the provision of the excursion or tour or for anything that happens during the course of its provision by the operator.

19. Delivery of Documents: All documents (e.g. invoices/tickets/Insurance policies) will be delivered to you either by post or electronically. Those that require to be posted will be sent to you by First Class post.
